1. Introduction
Please read these Terms of Use (“Terms”) carefully before using the Immersa platform (the “Service”), operated by Bereyziat Development Sàrl (Be-Dev), a company incorporated in Switzerland.
By accessing or using Immersa, you (“User”) agree to be bound by these Terms in full. If you do not agree to any part of these Terms, you must not use the Service.
Immersa is a professional, subscription-based video hosting, streaming, and distribution platform designed for filmmakers, studios, and professional content creators.
2. Eligibility
The Service is intended exclusively for professional users.
By using Immersa, you represent and warrant that:
You are at least 18 years old, or you are using the Service on behalf of a legal entity;
You have the legal authority to enter into these Terms;
You are using the Service for professional or commercial purposes.
Accounts may be created individually or on behalf of organizations, studios, or companies.
3. Accounts, Subscriptions, and Billing
Immersa is a subscription-based service and may include usage-based pricing components, including but not limited to:
Storage usage
Streaming bandwidth
Download bandwidth
Number of seats or users per organization
Subscription fees and usage-based charges are billed according to the selected plan.
Failure to pay may result in suspension or termination of access to the Service.
4. User Content and Ownership
Users retain full ownership of all content uploaded to Immersa, including but not limited to:
Video files (including immersive formats)
Audio
Images
Metadata
Titles, descriptions, and associated materials
Immersa does not claim ownership over user content.
5. License to Operate the Service
By uploading content to Immersa, you grant Immersa a worldwide, non-exclusive, royalty-free, revocable license strictly limited to:
Hosting and storing content
Encoding and transcoding content
Streaming and delivering content
Generating previews, thumbnails, and technical derivatives necessary for playback
Caching content via content delivery networks (CDNs)
Operating and maintaining the Service
Providing technical support
This license exists solely to operate the Service and terminates when the content is permanently deleted.
6. Content Responsibility
Users are solely responsible for ensuring they have all necessary rights, licenses, and permissions to upload, publish, and distribute content on Immersa.
Immersa does not pre-screen or actively validate content rights.
However, users must not upload content that:
Is illegal under applicable law
Infringes intellectual property rights
Contains unlawful, defamatory, or fraudulent material
Contains harassment, hate speech, or incitement to violence
Violates applicable regulations or third-party rights
Immersa reserves the right, at its sole discretion, to remove or restrict access to any content that is deemed unlawful, harmful, or in violation of these Terms.
7. Enforcement and Content Removal
If Immersa becomes aware of potentially unlawful or infringing content, we may:
Remove or restrict access to the content
Suspend or terminate accounts
Take other appropriate technical or legal measures
We are not obligated to monitor content proactively.
We may act without prior notice when necessary to protect the platform, users, or legal compliance.
8. Third-Party Services and Infrastructure
Immersa relies on third-party providers to operate parts of the Service, including:
SpatialGen – video streaming and content delivery infrastructure
Gracia AI – streaming and hosting of Gaussian splat / 4DGS content
Stock Spatial – optional content distribution and licensing marketplace
Where applicable, user content and related technical data may be processed by these providers strictly for the purpose of delivering the Service.
Each third-party provider operates under its own terms and privacy policies.
9. Content Distribution via StockSpatial
Users may optionally choose to distribute or license content via Stock Spatial.
In such cases:
Immersa acts solely as a technical and operational intermediary;
Immersa does not act as a reseller or rights purchaser;
No commission is taken by Immersa unless explicitly agreed in a separate contract;
Licensing terms between users and third-party buyers apply independently.
10. Data Deletion
Users may request deletion of their account or content at any time.
Upon deletion:
Content is permanently removed from active systems;
The User is solely responsible for maintaining backups before deletion;
Deleted content cannot be restored.
Residual copies may temporarily exist in backups for system recovery purposes but are not actively used.
11. Restrictions of Use
Users agree not to:
Use the Service in violation of applicable laws or regulations
Interfere with or disrupt the Service
Attempt unauthorized access to systems or data
Reverse engineer or copy core platform functionality
Misuse the Service to distribute unlawful or harmful content
12. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind.
Immersa does not guarantee:
uninterrupted availability of the Service
error-free operation
loss-free storage or streaming
compatibility with all devices or networks
Use of the Service is at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, Immersa and Bereyziat Development Sàrl (Be-Dev) shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to:
loss of data
loss of revenue or profits
business interruption
service delays or failures
third-party service failures
This applies even if Immersa has been advised of the possibility of such damages.
14. Intellectual Property of the Platform
All rights to the Immersa platform, including software, design, branding, and infrastructure, remain the exclusive property of Bereyziat Development Sàrl or its licensors.
Users are granted a limited, non-transferable license to use the Service.
15. Third-Party Links and Services
The Service may contain links or integrations to third-party websites or services.
Immersa is not responsible for:
third-party content
third-party policies
third-party availability or performance
Use of third-party services is at your own risk.
16. Termination
Immersa may suspend or terminate access to the Service:
for violation of these Terms
for non-payment
where required by law
where necessary to protect the platform or other users
Users may terminate their account at any time.
17. Modifications to the Terms
We reserve the right to modify these Terms at any time.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
18. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Switzerland (Canton of Vaud), without regard to conflict of law principles.
